Shared residence

Residence is a legal concept, defined by the Children Act 1989. Shared residence makes the parents equal in the eyes of the law and the eyes of the child. It is not connected to 'parenting time' or 'primary carer'. Some people contend that sole residence is immoral. The Children Act prefers no order - ie no residence order is preferable to a sole residence order. Parliament did not intend that sole residence orders be the norm.
